Me Rama Valayden, ancien Attorney General, monte au créneau pour venir prêter main-forte à Prakash Maunthrooa, Senior Adviser au Prime Minister’s Office. En effet, il a écrit officiellement à la Speaker de l’Assemblée nationale, Maya Hanoomanjee, pour protester contre « les attaques » subies par son client lors des délibérations à l’Assemblée nationale.
Rappelant que « the case in Court (Cause No 243/13) is reaching its concluding ends, latters are at a crucial juncture », Me Valayden souligne que « our Constitution has adopted the global principle of Presump- tion of Innocence to avoid miscarriage of justice ». Avec le Sub Judice Rule, l’homme de loi note : « Honourable Maunthrooa is not an Honourable Member of the National assembly and as such can’t defend himself against matter stated in the National assembly relating to him or his criminal case which may or may not be accurate. He has no right of reply and cannot correct or prevent any unfairness or inaccuracies. »
Me Valayden, se prévalant de précédents parlementaires, notamment en Australie, lance un appel à Maya Hanoomanjee « for the National Assembly not to become an alternative forum to a court of law which is in itself is a treacherous concept ». Et de poursuivre : « I pray that you use your wide powers to convey the message to the Honourable Members to respect the crucial principle of Sub Judice. »
